Rental Terms & Conditions
These terms govern the rental of boats, jet skis and paddle boards from Sea Mallorca in Santa Ponsa (Mallorca). By booking and paying through this website you expressly accept them in full, so please read them carefully before confirming.

1. Identification and acceptance
The service is operated by Sea Mallorca, whose identification details are set out in the Legal Notice. You can reach us at marcelo13flaque@gmail.com or on +34 683 547 583.
To complete a booking you must tick the acceptance box. By ticking that box and paying, you enter into a binding rental contract with Sea Mallorca and accept these Terms & Conditions and the Privacy Policy in full. We store the date, time and version of the text you accepted together with your booking.
Bookings made by WhatsApp, phone or in person are governed by these same terms, which we provide before the boat is handed over.
2. Subject of the contract
Sea Mallorca grants the customer temporary use of a boat, jet ski or paddle board, without crew, for the period booked. The customer acts as skipper and is responsible for handling the craft throughout the rental.
The rental does not include a skipper, a guide or an organised tour. Navigation is carried out under the customer's own responsibility.
3. Customer requirements
- Be at least 18 years old and present a valid ID card, NIE or passport on the day of departure.
- Hold the nautical licence required by the regulations in force on the rental date for the boat booked, where one is required. The original document must be shown before handover.
- Not be under the influence of alcohol, drugs or medication affecting the ability to skipper. The alcohol limits set by maritime regulations for skippers apply.
- Provide genuine contact details and a working phone with WhatsApp for the whole trip.
Sea Mallorca may refuse handover with no refund if the customer does not meet these requirements, shows clear signs of intoxication, or refuses to follow the safety instructions.
4. Booking, prices and payment
Published prices are in euros and include applicable taxes. The rental fee is paid in full online through Stripe at the time of booking; the booking is confirmed once payment is successfully completed.
Extras (waterproof cases, fins, drink packs) and additional people above the included capacity are charged at the rates shown at the time of booking.
We do not store card details: payments are processed entirely on the servers of Stripe Payments Europe, Ltd.
5. Security deposit
On the day of departure, before handover, the customer leaves a refundable deposit of €200 per boat (€100 for paddle boards; the amount for jet skis is confirmed when booking). Cash, Revolut or PayPal are accepted.
The deposit is returned in full and on the same day at the end of the rental, provided the equipment is returned on time, in the same condition as handed over and with no outstanding incidents.
The following may be deducted from the deposit, itemised and justified: the fixed amounts set out in clauses 7 and 8, the cost of repairing or replacing damage, unreplaced fuel where fuel is not included, extraordinary cleaning, and administrative fines attributable to the customer.
If the damage exceeds the deposit, the customer is liable for the difference. If it is lower, the remainder is returned.
6. Navigation area: maximum 2 nautical miles
The customer undertakes not to travel more than 2 nautical miles from the departure point (Santa Ponsa pier) at any moment during the rental.
This limit is an essential condition of the contract. It reflects both the rules applying to boats that may be operated without a licence — restricted to 2 miles from a port, marina or place of shelter and to daylight navigation — and the terms of the fleet's insurance cover.
Breaching this limit has, as a minimum, the following consequences:
- Total loss of the deposit.
- Possible loss of insurance cover: the customer becomes personally liable for all damage to the boat, to third parties and for rescue costs.
- Sole liability of the customer for any fines imposed by the Harbour Master, Maritime Rescue or other authorities.
- Immediate termination of the contract with no refund.
It is also prohibited to navigate outside the agreed hours, at night, while warning or no-swimming flags are in force, or in restricted, buoyed or marine-reserve areas where access or anchoring is limited. Anchoring over Posidonia oceanica seagrass meadows is prohibited in the Balearic Islands and carries substantial fines, payable by the customer.
7. Schedule and late return: €100
If the boat is returned later than the agreed time, €100 is deducted from the deposit, regardless of how long the delay is.
The return time is set in the booking and repeated in the pre-departure briefing. The customer must allow enough time and account for sea conditions to arrive punctually at the handover point.
If the delay prevents the next booking from departing, or exceeds one hour, the value of the lost rental and the cost of the additional hours at the current rate will also be deducted from the deposit. The €100 penalty does not release the customer from this obligation.
A customer arriving late at the meeting point does not extend the rental: the booked time starts at the reserved hour and the return time stays unchanged, with no discount or compensation.
8. Night-time assistance and rescue: €100
If Sea Mallorca has to go out to search for, tow or rescue the boat outside service hours or after dark, €100 is deducted from the deposit.
This €100 covers mobilising the team and the assistance boat. It is additional to any other applicable deduction, including the late-return charge in clause 7 where both apply.
Costs invoiced by third parties (Maritime Rescue, tow boats, port services, crane, repairs) are borne by the customer where the intervention results from misuse, negligence, running out of fuel through navigating outside the permitted area, or breach of these terms. The customer will not be charged where the breakdown is due to a pre-existing mechanical fault not caused by them.
In an emergency, the customer must contact Sea Mallorca immediately by phone or WhatsApp and, if people are at risk, Maritime Rescue (112 or VHF channel 16).
9. Obligations and prohibitions during the rental
- Wear the life jacket as instructed; compulsory for minors at all times.
- Never exceed the maximum authorised number of people on board, including babies and children.
- Do not transfer, sublet or allow the craft to be operated by third parties not named in the contract.
- Do not use the craft to carry goods, for commercial activities, competitions, towing people or objects, or any dangerous practice.
- Respect speed limits, buoyed swimming areas and minimum distances from the shore and from swimmers.
- Do not throw waste, fuel or oil into the sea.
- Report any breakdown, impact, grounding or incident immediately, however minor it seems.
- Return the craft clean, free of waste and with all equipment complete.
A serious breach of any of these points entitles Sea Mallorca to terminate the contract immediately and require an immediate return to port, with no refund.
10. Weather and safety
Sea Mallorca may suspend, shorten or reschedule a trip for safety reasons: weather warnings, port closure, sea state or instructions from the maritime authority. This is a technical decision and is not negotiable.
If the trip is cancelled for this reason before it starts, the customer may choose between rescheduling or a full refund of the amount paid.
If the trip is interrupted once under way, the unused portion of the time is refunded pro rata or an equivalent new date is offered.
If the customer decides not to go out when conditions are suitable, the cancellation rules in clause 11 apply.
11. Cancellations, changes and no-shows
- Cancellation more than 72 hours before the departure time: 100% refund of the amount paid.
- Cancellation within the final 72 hours: no refund, but we will try to reschedule the trip subject to availability.
- Failure to show up at the agreed time without notice: the full rental fee is forfeited.
- Date changes requested more than 72 hours in advance: free of charge and subject to availability.

12. Right of withdrawal
Under article 103(l) of the Spanish Consumer Protection Act (RDL 1/2007), the 14-day right of withdrawal does not apply to leisure service contracts provided on a specific date or period, which includes boat rentals.
This does not affect the voluntary cancellation terms in clause 11, which do apply, nor any statutory rights the consumer has if we fail to perform.
13. Liability, damage and insurance
The boats carry the compulsory third-party liability insurance required by Spanish law. The insurance does not cover damage arising from use contrary to these terms, from navigating outside the authorised area, or from operating the craft under the influence of alcohol or drugs.
The customer is liable for damage caused to the craft, its equipment, third parties or the environment during the rental period, unless it results from a pre-existing defect in the equipment or from force majeure.
Sea Mallorca is not liable for personal belongings taken on board, nor for indirect losses such as missed flights, bookings or connections.
Nothing in these terms limits Sea Mallorca's liability for wilful misconduct, gross negligence or personal injury, nor the non-waivable rights granted to the customer by consumer law.
14. Jet skis and paddle surf
Jet skis are used only within the area authorised by the port authority and following the instructions of Sea Mallorca staff. The minimum age and licence required depend on the model and are confirmed before departure; high-power models require a valid nautical licence.
Paddle boards are used inside Santa Ponsa bay, respecting swimming zones and staying close to the shore. Equipment must be returned within the agreed time and any breakage reported.
Except as stated in this clause, the same rules on deposits, late returns, assistance and liability set out for boats apply to all other equipment.
15. Force majeure
Neither party is liable for failure to perform caused by unforeseeable or unavoidable events beyond its control (storms, port closures, administrative restrictions, utility outages or health emergencies). In such cases a new date or a proportional refund will be offered.
16. Data protection
Data provided during booking is processed in accordance with the Privacy Policy, which forms part of these terms.
17. Complaints, governing law and jurisdiction
Official complaint forms are available to customers. You can send any complaint to marcelo13flaque@gmail.com; we will reply within a maximum of one month.
If you are not satisfied, you may contact the Consumer Affairs Directorate of the Balearic Government or the relevant Consumer Arbitration Board. The European Online Dispute Resolution (ODR) platform ceased operating on 20 July 2025 under Regulation (EU) 2024/3228 and is therefore no longer available.
These terms are governed by Spanish law. Any dispute will be submitted to the courts designated by consumer legislation; where the customer acts as a consumer, the courts of their place of residence have jurisdiction.
18. Validity and changes
Version 2026-08-05. Sea Mallorca may update these terms; each booking is governed by the version in force and accepted at the time of contracting, which is stored with the booking record.
